Why Pay for Bail if the Law Says Bail is Free?

A follower asked:

“I’m confused. The law says bail is free, but when someone is arrested, the police ask for money before granting bail. Why?”

The truth is this — the law is clear that bail is free.
Section 35(4) of the 1999 Constitution (as amended) and Section 30 of the Police Act, 2020 both affirm that no person should be unlawfully detained, and bail must not be paid for.

However, in practice, what happens in many police stations is illegal collection of money under the guise of “bail.” Officers often demand payment for things like “file opening,” “typing,” or “fuel,” but these are not recognized by law.

To be clear:

✅ Bail is a constitutional right, not a privilege.

✅ It should be granted free of charge.

❌ Any demand for money for bail is corruption and can be reported to higher authorities like the Police Complaint Response Unit (CRU).

In summary:
If you are told to “pay for bail,” remember — you are paying for illegality, not justice.
